Shopping

You may be able to purchase Heirlome products on this website. To process your purchase, we ask for information such as your name, billing and shipping address, telephone number, email address, and payment card information. We use this information to process your purchase, confirm your order, and deliver the items to you. If you give us permission, we also may use your contact information to communicate with you about our products, services, and promotions.

If you purchase an item on this site and ask us to deliver your purchase to someone else, we ask for the recipient’s name, postal address, and email address. We use this information to send the item to the recipient. If you ask us to do so, we also may use this information to notify the recipient of your purchase before it arrives.

Your Account

You may be able to register to create an account on our Web Site. To do so, we ask for information such as your name and email address. You also may provide your age and gender.

Through the “Registered Customer” feature, you can store billing and shipping information so you won’t have to enter it again when you make another purchase on this site. You also can store payment card information and details of your past purchases. In addition, you can save your credit card information on your account for faster checkout. Information Collected From You About Third Parties

If you send a gift card to a third party, we will collect both your and the third party’s name and e-mail address in order to send the third party an electronic gift card.

If you decide to invite a third party to purchase our products, we will collect your and the third party’s name, e-mail address, and/or social media account username in order to send a promotional message to the third party.

We rely upon you to obtain whatever consents from the third party that may be required by law to allow us to contact the third party. You or the third party may contact us at customercare@heirlome.com to request the removal of this information from our database. To make the referral process easier, we provide you the opportunity to import contact information directly from your address book. With your permission, we will access your address book and import your contacts’ information to facilitate the referral process. The communication that is sent to your friends may come from your e-mail address or social media account so that your friends know that you want to invite them to visit our Web Site.

Information Collected From Third Parties

We may receive personal information and/or data about you from certain third parties, such as demographic information from Facebook tools. We may add this information to the information we have already collected from you via our Web Site in order to improve the services we provide.

How We Protect Personal Information

We maintain appropriate administrative, technical, and physical safeguards to protect the personal information you provide on our Web Site or in our stores against accidental, unlawful, or unauthorized destruction, loss, alteration, access, disclosure or use and other unlawful forms of processing. We use Secure Sockets Layer (“SSL”) technology to protect the transmission over the internet of your payment card data. You can check the security of your connection by looking at the URL line of your browser. When accessing a secure site, the first characters of the site address change from “http” to “https.” If you are using a web browser or firewall that does not permit communications through secure sites, you will not be able to make purchases on our Web Site.

You may withdraw any consent you previously provided to us or object at any time on legitimate grounds and free of charge to the processing of your personal information, and we will apply your preferences going forward.

You can choose not to receive marketing communications from us by clicking on the unsubscribe link in our marketing emails or contacting us at customercare@heirlome.com. Please include your name, email address and postal address if you send us your request by email or postal mail. Our Web Site is not designed to respond to “do not track” signals received from browsers.

You may also ask us to refrain from sharing your information with certain of our affiliates and other third parties for their marketing purposes.

Children’s Privacy

Our Web Site is not directed to children under the age of 13 and we do not knowingly collect personal information from children under the age of 13 on the Web Site. In our Policy above, we have disclosed the categories of personal information we collected about you, the categories of sources for the personal information we collected about you, our business or commercial purpose for collecting that personal information, the categories of third parties with whom we may share that personal information.

You also have the right to request that we disclose the specific pieces of information we collected about you. Once we receive and confirm your verifiable consumer request, we will disclose to you the specific pieces of personal information we have retained about you.

You also have the right to request that we delete any of your personal information we collected from you and retained, with certain exceptions. Once we receive and confirm your verifiable request, we will delete (and direct our third party service providers to delete) your personal information from our records, unless an exception applies.

We reserve the right to not delete information that is necessary for us or our service providers to retain in order to:

a.Complete the transaction for which we collected the personal information, provide a product or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.

3.How to Request to Know or Request to Delete

You can submit verified consumer requests by emailing us at customercare@heirlome.com. We may require specific information from you to help us verify your identity and process your request. If we are unable to verify your identity, we may deny your requests to know or delete.

4.Right to Opt Out

You have a right to opt out of any sale of your personal information. We do not sell your personal information to any other retailers. However, our Web Site integrates technologies of trusted advertising partners (third-party companies) that allow the recognition of your device and the collection of information about your browsing activity in order to provide advertisements about goods and services likely to be of greater interest to you. In particular, these partners collect information about your activity on our Web Site to enable us to show advertisements for our products and/or services to you on third-party websites and apps. If and to the extent “sale” under the CCPA is interpreted to include advertising technology activities such as those implemented specifically for interest-based advertising, we will comply with applicable law as to such activity. 5.Authorized Agent

You can designate an authorized agent to submit requests on your behalf. However, we will require written proof of the agent’s permission to do so and verify your identity directly.

6.Right to Non-Discrimination

You have the right not to receive discriminatory treatment by us for the exercise of your privacy rights. We will never discriminate against you for exercising your privacy rights. However, there are certain functions of our Web Site that are only available to account holders, such as online credit, certain promotions, or a loyalty program, if applicable.

7.Financial Incentives

Financial incentives are programs, benefits, or other offerings, including payments to consumers as compensation, for the disclosure, deletion, or sale of personal information about them. There are no penalties for requesting disclosure or opting out of sharing of your personal information. However, if you request to delete your data (delete your account) we can no longer offer you certain discounts and promotions that are tied to your account. The value we obtain from collecting and analyzing data about account holders’ use of our Website and purchases is less than or equal to the value of the promotions and discounts we offer exclusively to those account holders. We also from time to time offer discounts connected to consumer’s submission of their email address or other personal information. The value of these discounts is greater than or equal to the value we obtain by being able to reach you about promotional offers. You can always opt out of our marketing emails or SMS messaging at any time.

8. Shine the Light

California Civil Code Section 1798.83 permits customers of Heirlome who are California residents to request certain information regarding its disclosure of personally identifiable information to third parties for their direct marketing purposes.
